These Terms and Conditions govern access to and use of Prompt Compare Lab, including account creation, workspace use, billing, and the platform's AI-assisted features.

1. Agreement to the Terms

By creating an account, accessing the service, or using Prompt Compare Lab, you agree to these Terms and Conditions. If you use the service on behalf of a company or other organization, you confirm that you have authority to bind that organization to these terms.

If you do not agree to these terms, do not create an account or use the service.

2. Eligibility and Accounts

You must provide accurate account information, keep your credentials confidential, and promptly update your information if it changes.

You are responsible for all activity that occurs under your account and for making sure your workspace users comply with these terms.

  • Do not share credentials with unauthorized users.
  • Do not impersonate another person or entity.
  • Notify us promptly if you believe your account has been compromised.

3. Acceptable Use

You may use the service only in compliance with applicable law and these terms. You may not use the service to infringe intellectual property rights, violate privacy or confidentiality obligations, transmit malware, abuse third-party systems, or generate or distribute unlawful content.

You remain responsible for reviewing prompts, uploaded materials, generated outputs, evaluations, and other workspace activity before relying on them in production, customer-facing, regulated, or safety-sensitive settings.

4. Customer Content and Outputs

You retain ownership of the prompts, files, datasets, instructions, and other content you submit to the service, subject to the rights needed for us and our subprocessors to operate the service.

You grant us a limited license to host, process, transmit, transform, store, and display your content only as needed to provide, secure, support, and improve the service.

AI-generated outputs may be inaccurate, incomplete, or unsuitable for your intended use. You are responsible for validating outputs and for how they are used.

5. Third-Party Services

Prompt Compare Lab relies on third-party services, including identity providers, payment processors, hosting infrastructure, storage providers, and AI model providers. Your use of third-party services through the platform may also be subject to their separate terms and policies.

We are not responsible for outages, policy changes, or performance issues caused by third-party services outside our reasonable control.

6. Plans, Billing, and Payments

Paid features, subscriptions, usage credits, and top-ups may be offered on the pricing terms shown in the product at the time of purchase. You authorize us and our payment processor to charge the payment method you provide for applicable fees, taxes, renewals, overages, and other charges you approve.

Unless otherwise stated in the product or required by law, fees are non-refundable. You are responsible for any taxes, duties, or similar charges associated with your use of the service.

7. Service Changes and Availability

We may update, modify, suspend, or discontinue features from time to time, including model availability, limits, workspace capabilities, and pricing.

We do not guarantee uninterrupted availability, error-free operation, or that every feature will remain available indefinitely.

8. Suspension and Termination

We may suspend or terminate access if we reasonably believe you violated these terms, created security risk, failed to pay required fees, or used the service in a way that could harm us, other users, or third parties.

You may stop using the service at any time. Termination does not relieve you of payment obligations incurred before termination.

9. Disclaimers

The service is provided on an as-is and as-available basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and any warranty arising from course of dealing or usage of trade.

10. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, goodwill, or business opportunities.

Our aggregate liability for claims arising out of or relating to the service will not exceed the amount you paid to us for the service during the twelve months before the event giving rise to the claim.

11. Changes to These Terms

We may update these terms from time to time. The updated version becomes effective when posted unless a later effective date is stated. Continued use of the service after the updated terms take effect constitutes acceptance of the revised terms.
